LandlordPro Tenant Screening — FCRA Compliance Agreement

By signing below, you agree to the following terms and certify your compliance with the Fair Credit Reporting Act (FCRA):

1. Permissible Purpose: You certify you will only order consumer reports for the purpose of evaluating prospective tenants, as permitted under the FCRA.
2. FCRA Compliance: You will comply with all applicable FCRA requirements, including providing proper written disclosures to applicants and obtaining written authorization before ordering reports.
3. Adverse Action: If you take any adverse action based on a consumer report (e.g., denial of housing), you will provide the required FCRA adverse action notice to the applicant.
4. Data Security: You will maintain appropriate administrative, technical, and physical security measures to protect consumer report information from unauthorized access or misuse.
5. Report Usage: Reports are strictly confidential and may only be used for lawful housing evaluation purposes. You will not share report contents outside your organization.
6. Credit Score Restrictions: Numeric credit scores will not be displayed. Only meets/does-not-meet determinations per your configured threshold, per FCRA requirements.
7. Income & Employment Verification Data Quality (Pro package only): Income and employment verification results are pulled from the applicant's payroll provider or linked bank account through our third-party data partner (Argyle). Verification quality depends on the data the applicant's provider makes available. For self-employed applicants, cash income, employers not connected to payroll networks, or thin deposit histories, results may be partial or inconclusive. You will receive whatever verified data is available, clearly labeled.
8. No Refunds: Because every search is executed in real time against third-party data providers (credit bureaus, court records, and — for Pro — payroll/bank networks), all screening orders are non-refundable once the applicant begins the consent and verification process, regardless of the outcome. Inconclusive income/employment results are not grounds for a refund. If the applicant never begins the consent process, the order may be cancelled at no cost.
